Unless expressly agreed otherwise in a written sales agreement, dsm-firmenich provides a warranty on the Delvotest® Accelerator Smart in accordance with the applicable General Terms and Conditions of Sale of dsm-firmenich (“GTCS”), which shall prevail in case of any conflict with this warranty statement. The Delvotest® Accelerator Smart is warranted to be free from defects in materials and workmanship for a period of one (1) year from the date of delivery, provided it has not been misused, altered, or repaired by any party other than dsm-firmenich, and that all mandatory updates have been installed in a timely manner. Supported Accessories are explicitly excluded from this warranty. Do not open or attempt to repair a defective Delvotest® Accelerator Smart. In the event of a defect, contact a dsm-firmenich representative immediately. Any unauthorized repair or modification will void the warranty. This warranty is subject to the limitations of liability set forth in the GTCS.
With respect to data related to Delvotest® Accelerator Smart, the customer, as the owner/controller of such data, remains fully responsible for compliance with all applicable data protection laws, including but not limited to the General Data Protection Regulation (GDPR) and other relevant local legislation. The customer shall fully indemnify dsm-firmenich against any damages, claims, or liabilities arising from a breach of such laws.
Dsm-firmenich will use reasonable efforts to maintain the security of any data stored on the Delvotest® Accelerator Smart while in its possession for repair. However, dsm-firmenich shall not be liable for any loss, damage, or unauthorized access to such data, except in cases of gross negligence or willful misconduct.
