Unless stipulated otherwise in the relevant sales agreement, DSM provides a warranty on the DelvotestĀ® Accelerator Smart in accordance with the applicable General Terms and Conditions of Sale of DSM (āGTCSā). Supported Accessories are explicitly excluded from this warranty. The Delvotest Accelerator Smart is warranted to be free from defective materials and workmanship for a period of 1 (one) year from the date of delivery, provided that the DelvotestĀ® Accelerator Smart has not been misused or altered in any way and provided that all mandatory updates have been installed in a timely manner. Do not open or repair defective Delvotest Accelerator Smart but contact a DSM representative immediately when a defect occurs. Products NOT repaired by DSM (third party repair) are explicitly excluded from the warranty.
Since the customer is the owner/controller of the Data on the DelvotestĀ® Accelerator Smart, the customer shall remain fully liable for compliance with all applicable data privacy laws with regards to such personal data and fully indemnify DSM for any damages suffered by DSM as a consequence of a breach thereof.
DSM shall use reasonable efforts to keep any data stored on the DelvotestĀ® Accelerator Smart secure, however DSM accepts no liability whatsoever for the security of any (personal) data contained on the Delvotest Accelerator Smart while it is in its possession for repair.
